1. Agreement

By accessing or using the Fancare Plus platform ("Service"), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Service.

2. Service Description

Fancare Plus provides a SaaS employee wellness assessment platform enabling companies to:

  • Invite employees to complete anonymous wellness assessments
  • Generate aggregated wellness reports and risk analyses
  • Access strategic recommendations for workforce health improvement
  • Connect with healthcare consulting services

3. Account Responsibilities

  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorised account access
  • You are responsible for all activity that occurs under your account
  • You must be authorised to register your organisation on the platform
  • You must ensure employees are informed about and consent to assessments

4. Subscription & Payment

  • Subscriptions are billed monthly in advance
  • Payments are processed by Stripe and subject to their terms
  • All prices are in EUR and exclude VAT unless stated
  • Subscriptions auto-renew unless cancelled before the renewal date
  • Refunds are not provided for partial months
  • We reserve the right to change pricing with 30 days' notice

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorised access to any part of the Service
  • Reverse engineer, decompile, or disassemble the platform
  • Transmit viruses, malware, or any harmful code
  • Use the Service to harass, discriminate against, or harm individuals
  • Resell or sublicence the Service without written permission

6. Employee Data & GDPR

  • You act as Data Controller for your employees' personal data
  • Fancare Plus acts as Data Processor on your behalf
  • You are responsible for obtaining valid employee consent before administering assessments
  • Employee responses are anonymised before inclusion in company reports
  • A Data Processing Agreement is available on request

7. Intellectual Property

All content, software, designs, and materials on the platform are the intellectual property of Fancare Plus. You receive a limited, non-exclusive licence to use the Service during your subscription.

8. Disclaimers

  • Assessment results are wellness screening tools, not medical diagnoses
  • The Service is provided "as is" without warranties of any kind
  • We do not guarantee uninterrupted or error-free service
  • Recommendations are advisory only and do not constitute professional medical advice

9. Limitation of Liability

To the maximum extent permitted by law, Fancare Plus's total liability for any claim arising from use of the Service shall not exceed the amount you paid in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

10. Termination

Either party may terminate the subscription at any time. Upon termination, your access to the platform will cease and your data will be retained for 2 years per our Privacy Policy before secure deletion.

11. Governing Law

These Terms are governed by Belgian law. Any disputes shall be subject to the exclusive jurisdiction of the courts of Antwerpen, Belgium.
